2. Scope and Purpose

These Terms and Conditions govern access to, browsing of and use of the website www.acsreformassevilla.com (hereinafter, “the Site”), as well as the engagement of services offered by ACS Reformas Sevilla through the Site or any other communication channel.

These terms apply to any person (hereinafter, “the User”) who accesses the Site or requests a quote or contracts any of our services, regardless of whether they act as an end consumer or a business.

3. Services Offered

ACS Reformas Sevilla provides, among others, the following services:

  • Full renovations of homes and commercial premises
  • Kitchen, bathroom and interior space refurbishments
  • Façade rehabilitation, repair and cladding
  • Façade and roof waterproofing
  • Custom kitchen design and installation
  • Interior design and themed environments
  • Building and community maintenance
  • Extensions and minor construction works

The detailed description of each service, together with materials, timelines and price, will be specified in the quote and signed contract agreed between the parties for each project.

4. Contracting Process and Quotation

  1. Quote request: the User may request a no-obligation quote via the Site’s contact form, by email or by phone.
  2. Site visit and assessment: where necessary, an ACS Reformas Sevilla technician will visit the property to evaluate the work required.
  3. Detailed quotation: provided in writing, with a breakdown of materials, labour, estimated timelines and payment terms. The quote is valid for 30 calendar days from its issue date, unless otherwise expressly stated.
  4. Acceptance and formalisation: the contract is formed upon signature of the quotation or engagement document by both parties. Until that point, neither party is under any contractual obligation.
  5. Start of works: ACS Reformas Sevilla will begin work on the agreed date, upon receipt of the initial payment if one has been stipulated.

5. Prices and Payment Terms

Prices are set out in each individual quotation and include applicable VAT unless otherwise stated. The following payment schedule generally applies, unless otherwise agreed in the contract:

Payment may be made by bank transfer, cash or other agreed methods. Failure to meet payment deadlines may result in the suspension of works, without prejudice to any legal action that may apply.

6. Project Timelines

Execution timelines will be set out in the contract and are estimates based on standard working conditions. ACS Reformas Sevilla undertakes to notify the client in good time of any circumstance that may affect the agreed schedule. Delays arising from the following shall not be attributable to ACS Reformas Sevilla:

  • Modifications requested by the client during execution.
  • Force majeure events (adverse weather, strikes, material supply shortages, etc.).
  • Delays in obtaining licences or administrative permits where their processing is the client’s responsibility.
  • Restricted access or property conditions not communicated in advance.

7. Client Obligations

The client undertakes to:

  • Provide access to the property during agreed working hours.
  • Supply accurate and complete information about the property’s condition and the work required.
  • Obtain, where it is their responsibility, any licences and permits required for the works.
  • Make payments on the dates and under the conditions agreed.
  • Communicate any modification or extension to the original scope of work in writing.
  • Designate, if they wish, a point of contact for project follow-up.

8. Warranties

ACS Reformas Sevilla provides the following warranties on completed works, in accordance with Spanish Building Act 38/1999 (Ley de Ordenación de la Edificación) and other applicable regulations:

Warranties do not cover damage caused by misuse, modifications carried out by third parties not engaged by ACS Reformas Sevilla, inadequate maintenance by the client, or force majeure events.

9. Liability and Limitations

ACS Reformas Sevilla is liable for direct damages caused by proven fault or negligence in the execution of contracted works. The following are excluded from liability:

  • Indirect damages, loss of profits or business losses suffered by the client.
  • Damage arising from pre-existing latent defects in the property not disclosed at the start of works.
  • Damage caused by the client’s failure to fulfil the obligations set out in section 7.
  • Damage arising from fortuitous events or force majeure.

ACS Reformas Sevilla holds public liability insurance to cover potential damage to third parties occurring in the course of works.

10. Intellectual Property

All content on the Site — texts, images, logos, designs, project photographs and any other element — is the property of ACS Reformas Sevilla or its legitimate rights holders, and is protected by Spanish and international intellectual and industrial property law.

Reproduction, distribution, transformation or public communication of any Site content without prior written authorisation from ACS Reformas Sevilla is strictly prohibited. Use of content for commercial or advertising purposes will be subject to conditions agreed in writing.

11. Use of the Website

The User undertakes to make lawful use of the Site, refraining from:

  • Uploading unlawful or offensive content or content that infringes third-party rights.
  • Using the Site to send unsolicited communications (spam).
  • Attempting to access systems, servers or networks without authorisation.
  • Taking any action that could damage, overload or impair the functioning of the Site.

ACS Reformas Sevilla reserves the right to interrupt or restrict access to the Site, without prior notice, for maintenance, security or any other justified reason.

12. Links to Third-Party Sites

The Site may contain links to third-party websites. ACS Reformas Sevilla does not control and is not responsible for the content, privacy policies or practices of those sites. The inclusion of a link does not imply endorsement of or any commercial relationship with the linked site.

13. Amendments to These Terms

ACS Reformas Sevilla reserves the right to amend these Terms and Conditions at any time to reflect legislative changes, Site improvements or variations in the services offered. The updated version will be published on this page with the new effective date. Continued use of the Site after changes are published constitutes acceptance of the updated terms.

14. Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law, in particular:

  • Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE).
  • Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Defence of Consumers and Users.
  • Law 38/1999 on Building Regulation (Ley de Ordenación de la Edificación).
  • The Spanish Civil Code and any other applicable regulations.

For the resolution of any dispute arising from use of the Site or the contracting of our services, the parties submit, expressly waiving any other jurisdiction that may apply, to the Courts and Tribunals of Sevilla. However, where the User is a consumer, consumer protection legislation shall apply and they may bring proceedings before the courts of their place of residence.
